BrandHub Agency – Engagement Terms
1. Minimum Engagement Requirements
All client engagements with BrandHub Agency (a division of Benaiah Joseph Holdings LLC) must meet the following minimum requirements:
- Digital Marketing Services: $2,500/month minimum commitment
- IT Consulting & Infrastructure Services: $8,500/month minimum commitment
- Restaurant & Retail SaaS Deployments: $3,500 to $7500 one-time setup + applicable monthly service fees
2. Automatic Billing Policy
All clients must maintain a valid credit card on file. By engaging our services, you authorize BrandHub Agency to auto-charge all applicable invoices, including:
- Initial setup fees
- Monthly recurring services
- Licensing and software renewals
- Retainers, consulting hours, or scoped milestones
3. Strict No-Refund Policy
We do not offer refunds for any reason. This includes, but is not limited to:
- Cancellations after project start
- Change of mind
- Communication disputes
- Unused service time
- Delays caused by third parties or lack of client responsiveness
All labor, SaaS systems, and creative resources are allocated at project initiation. We operate with scheduled developer queues, booked infrastructure, and live licensing environments — making reversals infeasible. All refund requests will be denied.
4. ADA Compliance Enforcement
BrandHub Agency fully supports and enforces the Americans with Disabilities Act (ADA). It is mandatory that all client websites and ordering platforms remain ADA compliant. Failure to comply:
- Will result in immediate notice
- May result in service suspension
- Will be reported to ADA compliance authorities
- Will be escalated for legal review
We maintain this policy as our team includes individuals protected under the ADA. Non-compliance is both unethical and unlawful.
5. Communications Policy
All service and billing communications must be submitted in writing to:
support@brandhub.agency
We do not accept support or billing communication via phone, text, or personal contact. All client communication is entered into a support queue and processed in writing to ensure legal compliance and proper documentation.
6. Dispute Resolution
If you believe you have been billed in error, you must submit:
- Invoice ID(s)
- Service description
- Billing date
- Explanation of dispute
BrandHub Agency will perform an internal audit. If a valid duplicate charge is verified, a credit may be applied toward your account. No refunds will be issued under any circumstances.
7. Ownership & Licensing
All code, software, modules, and systems remain the intellectual property of BrandHub Agency unless otherwise agreed upon in a signed licensing agreement. Clients receive non-transferable, non-exclusive usage rights only.
8. Terms Subject to Change
We reserve the right to modify these terms at any time without prior notice. Continued use of services constitutes acceptance of the latest version, which is always available at www.brandhub.agency.
9. Termination
We reserve the right to suspend or terminate service for:
- Non-payment
- Policy violations
- Hostile or abusive behavior
- Compliance risks
- Business discretion
No refunds will be issued upon termination. Credits or balances due remain applicable and collectible.
